You need Bess Law Group on your side.  Do not trust the banks to stop your foreclosure while they are negotiating a mortgage modification or short sale.    Either through deceit or incompetence, Mortgage Lenders often go through with the mortgage foreclosure even while they are negotiating with you to pursue alternatives.

The Bess Law Group will not charge you to help defend your foreclosure.  Many foreclosure attorneys charge their clients an unreasonable amount to defend foreclosures, and many attorneys charge their clients a certain amount each month to stay in their homes.  Still others will charge new fees every few months in order for the attorney to keep representing you.  These fees are often based upon the time that you stay in your home, and not on the time the attorney actually spends on your case.

The Bess Law Group believes in finding long term solutions for their foreclosure clients, and will not charge you for what many attorneys call STRATEGIC DEFAULTS.  In some cases, these so-called strategic defaults buy time for their clients, but do not resolve the ultimate issue: GETTING RID OF YOUR UPSIDE DOWN OR UNDER WATER HOME WITHOUT FUTURE LIABILITY.  We will help you buy time in your home without charge, and look for more permanent resolutions to your long-term issues to restore your peace of mind.

MORTGAGE MODIFICATION

The Bess Law Group can help you even if you are behind on your mortgage payments.  If you hire the Bess Law Group to fight your foreclosure, we may be able to keep you in your home, payment free, while we work out an affordable modification with your bank.  Carole Bess, along with a few other attorneys, mediators, and the Chapter 13 Trustee, helped put together one of the most successful mortgage modification program in the country.  The program has an 86% success rate, while most other programs have a 4-10% success rate.  If you hire an attorney to help you with your modification, ask that attorney for documentation of their success rate for modifications.  The mortgage modification program in the Chapter 13 program costs $1800.00-$2000.00 in attorney fees, which can largley be paid in the Chapter 13 plan over time.  If you want to save your home, make sure you are not paying an attorney too much for their services, and make sure your chances of success are as high as they can possibly be.

SURRENDERING YOUR HOME

If, after weighing all of your options,  you have decided to surrender your home, you probably need the help of an attorney.  Do not simply walk away from your home, or you may face grave financial consequences down the road.  The Bess Law Group may help you stay in your home as long as possible without charging you attorney fees, and later can help you avoid a deficiency judgment.  A deficiency judgment is a money judgement that's entered against you, for the difference between what you owe on your house, together with attorney fees and costs, versus the amount that your house is eventually sold at auction.  The Bess Law Group may also help you avoid any tax consequences to surrendering your home.  DO NOT SURRENDER YOUR HOME WITHOUT THE HELP OF AN ATTORNEY!

REMEMBER, the worst thing you can do if you are behind in your mortgage payments or are facing foreclosure, is to ignore the situation.  Don't bury your head in the sand!  Don't keep losing sleep!  Call us, now, and we will help you!

Bankruptcy

Bankruptcy is not a dirty word.  It is simply a business decision that is sometimes necessary.  Did you know that Abraham Lincoln and Henry Ford both filed bankruptcy? You should not feel guilty about filing bankruptcy if you are overwhelmed by debt. Bankruptcy laws are in place for a purpose. The laws exist to help people like you get the relief they need. In 2012, there were more than 46,000 bankruptcies filed in the Orlando bankruptcy court.  There are many advantages to bankruptcy.

Filing for bankruptcy, can stop lawsuits including foreclosures, IRS garnishments, garnishmenst of your bank and your wages, and delay or stop repossessions.

There are several types of bankruptcy chapters.  The most common types of bankruptcy for individuals are Chapter 7 and Chapter 13.  While either type of bankruptcy, can offer you relief from your creditors, it is important to know which type of bankruptcy is right for you.  YOU NEED AN EXPERIENCED ATTORNEY TO HELP YOU DECIDE, WHICH IF ANY, BANKRUPTCY YOU SHOULD FILE!

Carole Bess has been practicing law for 23 years in Brevard County.  She was featured on 60 Minutes, and was interviewed by Scott Pelley of CBS.  She has published several articles,  and spoken at many seminars, including the Central Florida Bankruptcy Association.  She and her associaters, Eric Washington, & Andrea Dwyer, can advice you on what, if any type of bankruptcy is right for you.     For more information on the bankruptcy process and the debts that you can eliminate, contact our office for a free consultation.

The Bess Law Group will treat you with respect and dignity. We know you already feel bad about not being able to pay your bills. We understand you feel overwhelmed and often depressed at the shear amount of debt that you may have. Our clients often experience harassing phone calls, stress, humilation, and sleepless nights before meeting with us. We can help! We can guide your steps to a debt-free existence. Many of us in the Bess Law Group have been through bankruptcy ourselves and have survived. We can get you through this experience and help you keep your dignity at the same time. We will always treat you with the respect you deserve.

Our attorneys at the Bess Law Group will listen to your story and answer your concerns and worries.  It is our goal to give you back your peace of mind.  We will not advice you to file bankruptcy if this is not the appropriate avenue for you.  Often times we are able to work out agreements with your creditors to avoid bankruptcy.  We want to help you make an informed decision about whatever financial and legal crisises are facing you at this time.

HIRE AN EXPERIENCED ATTORNEY!

Filing for bankruptcy protection is an important step, and you should not try to "go it alone."  You should also make sure your bankruptcy attorney is qualified to file your bankruptcy.  Make sure your attorney has the experience you need.  Ask any prospective bankruptcy attorney how long they have been practicing bankruptcy law, and ask how many chapter 13s the attorney has filed, and how many chapter 7s, the attorney has filed.  If an attorney has not filed very many chapter 13s, that should be a red flag the attorney may not be as experienced as you need.
